  1. You are packed and ready to go on your motorcycling holiday abroad. Maps, Sat Nav, credit card, and toothpaste. Just the mosquito spray and clean underpants to get. Your bike is brimmed with petrol and ready to board the ferry for France or Spain. Your Passport is up to date and all the arrangements for contact numbers with friends and relatives have been made; but what about motorcycle repatriation insurance?

    You are fit and healthy and your motorcycle is in good condition and only has nine thousand miles on the clock which brings it well within the guarantee period.  

    Your aged parents need travel insurance, so why should you? If need be, you’ll push your motorcycle back to the Ferry in the event of a breakdown, or if you have to, in the event of a motorcycle accident you can leave it at the roadside and get the nearest plane back.  

    But what if you are so seriously injured that you have to be flown back to the UK by air ambulance (repatriated)? What if you contract a disease that renders you unconscious? What if you injure other people and you are at fault? The ‘what ifs’ are endless and so are the bills that will follow you around if you aren’t insured, this is when you think “I should have taken the motorcycle repatriation insurance option on my bike policy”. Cases have been known to attract bills that can amount to hundreds of thousands and sometime millions of pounds.  

    These aren’t the kind of cases that you can go to the County Court with and offer to pay at £5 per week. Medical Insurance companies don’t mess around for their money and usually bankrupt you and take your home and possessions from you. And all because you decided that you didn’t need motorcycle repatriation insurance.  

    Repatriation for injured motorcyclists is a costly procedure. Imagine the hospital bills and travelling bills that have to take into account the recovery of your machine. So, what sort of Insurance will you need? How much will you need to be covered for? To be on the safe side, two million pounds worth of cover should be adequate to take care of your needs. You must also make sure that your motorcycle insurance policy covers you for motorcycle repatriation. Another essential is the need for 24 hour coverage. Accidents and illness don’t take heed of what time of day or night it is; but motorcycle insurers and the emergency services do. You must read the small print and understand what you are and are not covered for BEFORE YOU GO.  

    ‘Support’ insurance will offer you exactly what it says on the document. It will offer you accident assistance and medical treatments. It will also offer you motorcycle legal assistance when you need it most. In some countries, once you are involved in an accident, the matter involves the Police that will usually want to arrest you and incarcerate you in a cell from the moment you are well enough to be imprisoned; guilty or not!   Also check with you bank or any personal insurance you may have. Check with your credit card company to see if they offer you insurance that includes motorcycle repatriation.  

    Members of the European Union can obtain basic motorbike insurance cover for medical emergencies and treatment through the EHIC scheme. It is worth looking at the terms and conditions that it offers. Remember, it is only basic insurance and will not cover emergency motorcycle repatriation.   Always take copy documentation with you and leave copies with people who are the first point of contact. Always leave contact details about your person in case you are rendered unconscious and details of your identity are needed as a matter of urgency by the emergency services.  

  2. Why do motorcyclists filter? The answer is, because they can!

    Guided by the brain of an experienced biker, a motorcycle is one of the smallest yet most powerful machines on the planet. Maneuverability is its second name and its ability to negotiate the tightest traffic jams has been accepted since traffic jams were born. But is it legal? Here we discuss filtering and its effect upon accident claims.  

    The relationship with cars and heavier vehicles is inextricably linked since it is they that we negotiate when filtering and furthermore it is they that usually send us flying across the road surface when they come into contact with us.  

    You have to go back to basics to understand your relationship with legality and who actually owes a duty of care to whom. Let’s start with the Highway Code and learn what it says. It is quite precise in what it says about the standard and duty of care of car drivers. (In this I also refer to ‘car drivers’ as meaning other road users of light and heavy goods vehicles.) Accidents are usually caused when vehicles are maneuvering whilst stuck in queues.

    We bikers like to refer to it as impatience. The Highway Code is quite specific when it refers to maneuvering in that it states   “You should be aware of what is behind and to the sides before manoeuvring. Look behind you; use mirrors if they are fitted. When in traffic queues look out for pedestrians crossing between vehicles and vehicles emerging from junctions or changing lanes. Position yourself so that drivers in front can see you in their mirrors. Additionally, when filtering in slow-moving traffic, take care and keep your speed low.”  

    So, just how many seem to forget this basic and simple rule of motoring? You don’t need a bead board to count them at rush hour.  It continues with this simple golden rule: “Remember: Observation – Signal – Manoeuvre”   Some say that rules are made to be broken, and so are necks and limbs, but that doesn’t make it alright.  

    Rule 204 states   “The most vulnerable road users are pedestrians, cyclists, motorcyclists and horse riders. It is particularly important to be aware of children, older and disabled people, and learner and inexperienced drivers and riders.”   Quite specific I would say. Whilst I don’t want to bore you with endless quotations I think that it is important to note what else is said in the Highway Code. These passages will be useful to you in the event of an accident, so we cannot emphasis strongly enough that you be aware of them.  

    Under the sub heading of ‘Motorcyclists and cyclists’, Section 211 says:   “It is often difficult to see motorcyclists and cyclists, especially when they are coming up from behind, coming out of junctions, at roundabouts, overtaking you or filtering through traffic. Always look out for them before you emerge from a junction; they could be approaching faster than you think. When turning right across a line of slow-moving or stationary traffic, look out for cyclists or motorcyclists on the inside of the traffic you are crossing. Be especially careful when turning, and when changing direction or lane. Be sure to check mirrors and blind spots carefully.”   Thereafter, section 213 states:   “Motorcyclists and cyclists may suddenly need to avoid uneven road surfaces and obstacles such as drain covers or oily, wet or icy patches on the road. Give them plenty of room and pay particular attention to any sudden change of direction they may have to make.”  

    The advice isn’t rocket science; it’s just a matter of using good road sense and using mirrors and making yourself aware of what is around you. But you must be aware that whether you are on a moped, scooter or high powered motorcycle, filtering is one of the most hazardous and dangerous things you can do. Perfectly legal; yes, but dangerous – very, very dangerous.   Motorcyclists are constantly aware of what drivers do, but that is not so of drivers who sometimes seem oblivious to motorcycles and scooters. Very recently the term ‘think bike’ was used to press the point home in a national campaign to make drivers aware of bikers. That should tell you something about the ‘driver’ mentality. At all times, we are aware of them but sometimes they are oblivious of us and that can be to our detriment. So what happened to that successful campaign? Like most useful campaigns it appears to have been shelved. Maybe they think that the message has got home, but whoever thought that could not be more wrong. Just visit any Orthopaedic ward and look at the long line of legs in plaster that say otherwise.

    Everybody recognises the vulnerability of motorcyclists when a collision occurs, and this is made quite plain in the Highway Code. But despite this, we constantly see cases where motorcyclists are persuaded to accept a certain amount of blame apportionment because some courts see filtering as being a contributory fact. In this legal system, cases are usually decided by considering earlier cases that are referred to as ‘precedents’. A precedent is where the facts of one case can be applied to another and the reason for deciding the case outcome is usually made by the Judge whose comments are taken into account. This ‘reason for deciding’ rule follows in all cases, and whilst sometimes it can be inappropriate to your case, the danger is that it can be used to persuade the court in favour of a driver as opposed to a motorcyclist.   There have been cases in the past where motorcyclists have been found to be 100% at fault when they have been filtering.  

    When it comes time to argue compensation in cases involving filtering or overtaking, contributory negligence is always argues against the motorcyclist. Being aware of your rights before you even visit your lawyer this can sometimes ensure that unreasonable arguments simply being made to save the Insurers money can be nipped in the bud.  

    In some countries they call it line riding, and in the US they call it ‘lane splitting’. There have been various attempts to argue the legality of this type of manouvre made by bikers over the years.   In Europe, the MAIDS Report was conducted using (OECD) standards in 1999–2000 and collected data on over 900 motorcycle accidents in five countries, along with non-accident exposure data (control cases) to measure the contribution of different factors to accidents. Four of the five countries where data was collected allow lane splitting or filtering, while one does not, yet none of the conclusions contained in the MAIDS Final Report note any difference in rear-end accidents or accidents during lane splitting.  

    It should be noted that the pre-crash motion of the motorcycle or scooter was lane-splitting or filtering in only 0.4% of cases, in contrast to the more common accident situations such as "Moving in a straight line, constant speed" 49.1% and "Negotiating a bend, constant speed" 12.1%. The motorcyclist was stopped in traffic prior to 2.8% of the accidents.   Preliminary results indicate that from a study in the United Kingdom, conducted by the University of Nottingham for the Department of Transport indicated that filtering and lane splitting is responsible for around 5% of motorcyclists that are killed or injured. It also found that in these cases where filtering took place the motorist or car driver is twice as likely to be at fault as the motorcyclist due to drivers "failing to take into account possible motorcycle riding strategies in heavy traffic". Maybe some would conclude that the results aren’t conclusive, but the indications point directly at car drivers as opposed to motorcyclists.  

    To conclude, what we are certain of is that in the majority of cases of collisions where car drivers pull into the path of motorcyclists, bikers get a raw deal if they are caught ‘filtering’. The stigma attached to this relatively harmless yet safe mode of traffic negotiation has become a dirty word in the eyes of some lawyers and insurance companies.   In short the word filtering has just become a stick with which to beat the poor old biker, yet again.   If you are going to filter, be aware at all times that you could be dubbed the aggressor. If that will satisfy the greed of the insurers and their defendant lawyers in their endless quest to save their shareholders money, then you must understand that you will have your work cut out for you in the event of an accident.  

    The biker’s motto should be: “Think once, think twice, think idiot!”...

    Remember this when referring to other drivers and you won’t go far wrong.

  3. Right To Ride has responded to a Road Safety public consultation on an European Union (EU) strategy to reduce injuries resulting from road traffic accidents.
     
    The consultation, a survey from the European Commission’s (EC) Energy and Transport states that “Road safety strategies traditionally focus on reducing fatalities. Injuries, however, are overlooked and have become a major health problem. In 2010, about 1 500 000 people were injured on the roads of the European Union, at huge economic and human cost to society.” adding that, “Reducing the number and the severity of road traffic injuries is one of the strategic objectives outlined in the Policy Orientation on Road Safety 2011-2020 and a priority for EU action.”
     
    Therefore the EC say that it is, “Developing a comprehensive strategy of action concerning road traffic injuries and emergency services, with the help of all relevant actors.”
     
    The EC says that initially, “It will seek to find a common understanding of definitions and concepts relating to casualties (in particular, the definition of serious and slight injuries), improve data collection and identify courses of action to improve prevention and intervention, including their socio-economic impact.” and that based on feedback from the first stage of the proposed strategy, “Specific or tailor-made actions might be identified with a view to increasing the accuracy of existing databases on road injuries”.
     
    This initial stage appears to be whether the count of road injuries is accurate.
     
    Questionnaire
     
    The questionnaire asks participants to list references to any studies or documents of relevance to this consultation on injuries resulting from road accidents. If you are aware of any study or document or the organisation, group or association you may be a member of has produced any studies or documents you can forward these to the EC.
     
    At Right To Ride we have forwarded the EC our Northern Ireland Motorcycle Fatality Report 2012, the report is an Indepth Study of 39 Motorcycle Collisions In Northern Ireland between 2004 and 2010 where 41 Motorcyclists were Fatally Injured.
     
    Towards a European Road Safety Area
     
    Meanwhile in the EC document – Towards a European road safety area – Policy orientations on road safety 2011-2020 which is being promoted as EU road safety guidelines 2011-2020, it specifically mentions motorcyclists as vulnerable road users.
     
    Specifically making vulnerable road users – especially motorcyclists – safer by improving communication between authorities and road users, and introducing periodic inspections of motorbikes, mopeds, etc.
     
    The document says that, “The problem of motorcyclists’ safety ” should be addressed through a range of actions, with a view to:
     

    1. Improving awareness of PTW (Powered Two Wheelers – motorcycles – scooters – mopeds) riders by other road users.
     

    2. Encouraging research and technical developments aimed at increasing PTW’s safety and reducing the consequences of accidents, such as standards for personal protective equipment, airbags, the use of relevant ITS applications (e.g. eCall) and progressive installation of advanced braking systems, appropriate anti-tampering measures, etc.
     

    The Commission will propose to extend to PTWs the existing EU legislation concerning roadworthiness testing. Finally, on-going efforts to better adapt road infrastructure to PTWs (e.g. safer guardrails) should also be continued.
     

    3. Encouraging Member States to focus enforcement on speed, drink and driving, helmet use, tampering and riding without a proper PTW licence.
     
    You may be familiar with some of these issues that the EC is already progressing with such as mandatory advanced braking systems and appropriate anti-tampering measures in the proposed EU Regulation that is presently under discussion you may not be aware of these other range of actions.
     
    The problem with these actions is that, although we can simply welcome the on-going efforts to better adapt road infrastructure to PTWs (e.g. safer guardrails,) the issue is what is in the detail for improving awareness of PTW riders by other road users.
     
    While encouraging research and technical developments aimed at increasing PTW’s safety and reducing the consequences of accidents, is welcome what are the details of standards for personal protective equipment, airbags, the use of relevant ITS applications (e.g. eCall) and rather than a concentration on the consequences of accidents a step back to concentrate on looking at the prevention of accidents would be more appropriate.
     
    Of course nobody would deny that enforcement on drink and driving is to be encouraged however perhaps enforcement on speed should be on inappropriate speed, helmet use is more a “Southern” European issue and tampering and riding without a proper PTW licence suggests that there is only an issue with PTW Licences.
     
    Bundle these actions together as “The problem of motorcyclists’ safety” the problem then becomes the motorcyclists acceptance and the problem of throwing out the bath water, baby and all, with any EU proposals on regulation or policy on improving motorcyclists safety.
     
    It’s all a balancing act as all this will not go away, so from Road Safety Consultations to EU Regulations to Road Safety reports, a certain flair to understanding the depth of these issues and how they are interlinked and can be dealt with, without ending up looking at an empty bath and sitting on a heavily regulated motorcycle.

  5. As bikers ourselves, we thought a gentle reminder and some basic riding tips may be in order especially if you have not  ridden for a while.  

    Always give yourself space.
    People driving cars often don’t see motorcycle riders. Even when drivers do see you, chances are they’ve never been on a motorcycle and can’t properly judge your speed.  

    Be visible at all times:

    Remember that motorists often have trouble seeing motorcycles and reacting in time.
    Make sure your headlight works and is on day and night. Use reflective strips or decals on your clothing and on your motorcycle.
    Be aware of the blind spots cars and trucks have.
    Flash your brake light when you are slowing down and before stopping. If a motorist doesn’t see you, don’t be afraid to use your horn.  
    Dress for safety: Wear a quality helmet and eye protection. Wear bright clothing and a light-coloured helmet.
    Wear leather or other thick, protective clothing. Choose long sleeves and pants, over-the-ankle boots, and gloves.
    Remember – the only thing between you and the road is your protective gear.  

    Apply effective mental strategies:

    Constantly search the road for changing conditions.
    Give yourself space and time to respond to other motorists’ actions.
    Give other motorists time and space to respond to you.
    Use lane positioning to be seen; ride in the part of a lane where you are most visible.
    Watch for turning vehicles.
    Signal your next move in advance.
    Avoid weaving between lanes.
    Pretend you’re invisible, and ride extra defensively.
    Don't ride when you are tired or under the influence of alcohol or other drugs.
    Know and follow the rules of the road.
    Stick to the speed limit.  

    Follow these basic steps to protect you and your beloved machine.
